15-Year-Old Girl Indicted

A stunning, horrifying story from Missouri, as the state struggles over the question of what to do with a 15-year-old-girl indicted for the murder of her 9-year-old neighbor.

Though she did well in school Alyssa Bustamante had been a troubled child with mental health issues, reportedly attempting suicide at 13 and compulsively cutting herself. But nobody saw it coming what she was arrested for this week: strangling and stabbing to death her next-door-neighbor who was only 9 years old. Now the state, lawyers and child psychiatrists are grappling whether to try her as an adult for the murder charges or treat her as a minor, what sort of facility to house her in and other questions. And families are left to piece together the wreckage left behind by this unthinkable act...our hearts go out to them as they deal with this and find the way to live on.

Alyssa Bustamante strangled 9-year-old neighbor Elizabeth Olten without provocation, cut the girl's throat and stabbed her, prosecutors said. Why? "Ultimately, she stated she wanted to know what it felt like," Missouri State Highway Patrol Sgt. David Rice testified Wednesday during a court hearing over the slaying...

The devil is so busy ruining our kids live and no one seem to care. A person with mental health issues is attacked by satan because their minds are weak. He is using their mind to destroy our kids. I speak boldly against this IN Jesus Name! he will hot destroy our babies, because they are our future. In Jesus Name!

It is so hard for young people in this day and age. Parents need to watch for signs of distress in their children and get treatment early. Too many parents bury their heads in the sand and only see their children through rose-colored glasses. Even those parents who do all the right things (at least to them) can make mistakes. NEVER assume that it can't happen to your child.

Posted by: Judie at November 19, 2009 8:22 AM

This is horrible. Murder is a crime and it doesnt matter how old you are. You know the difference between right and wrong and they need to investiagte if there was something going on in the home that could make the child like that. I agree the devilis out to kill, steal, and destroy and she should have a very cruel punishment. A 9 year old child? what is that 2 grade? yeah that is horrible and she chould be tried as an adult and she should be made appologise to the childs family because a chid is a gift from god and when you take that you cannot get it back, no matter what. If someone was to ddo something like this to my child, I would go crazy if they thought that the killer would be crazy, they should see this momma. I hope the girls rots in hell

This was a tragic event yes, but what we need to remember Alyssa is a child, a child with mental issues. lets take a step back and put ourselves in parent mode, would u want your child put to death? This child needs psychiatric help. Puttind some one to death is not the only logic way of handling the situation.

Posted by: emily soto at November 19, 2009 8:30 AM

May God be with the family in their hour of need and know that she is with her Father in Heaven and will be reunited with her family again one day. We also have to pray for the Bustamante family in their agony knowing and living with what their daughter has done to another child of God, but if God can forgive so can we. I pray the Lord will help heal both families during this difficult time.

This is an easy one. Look, a 15 y.o. boy was recently tried as an adult here [Rochester, n.y.] for murder of an adult man, found guilty & sentenced to 25 years to life in jail. Now pay attention ; this girl can get all the counseling she needs from prison doctors.. She should be made a model of what NOT to do to your neighbor under ANY circumstances instead of being mollycoddled with the mental heath card.. This should be no large issue in the midwest. Here, they displayed no second thoughts of considering anything except to lock the boy up; in lieu of affording the girl sexist treatment, they should follow the same procedure as here.

Posted by: Hannibal at November 19, 2009 8:40 AM

Yes, let's step back and put ourselves in "parent" mode. Would you want your child put to death? Well, I'm sure the parents of the 9 yr old didn't want her put to death either. But no one was given an option, now were they? This girl committed a premeditated murder "just to see how it feels" and you think there's hope for what? Rehabilitation? Some things are just beyond fixable and she would probably find herself in and out of mental institutions. If allowed to live, this young woman will become a predator upon society, just like the man that killed Shaniya Davis. Remember, even if given the death penalty, it would be many years before it was carried out and she would no longer be a "child". Fifteen or not, she knows right from wrong. She made the decision.

ANYONE that kills someone else other than in self defense has mental issues! how lawyers use mental illness to get a lesser sentence is just another example of the laws being twisted to favor the guilty. i for one, am sick of the guilty having rights, while the victims are forgotten. when do you think we will ever hear about victim's rights? oh wait, i forgot, they're dead!

Posted by: dan at November 19, 2009 8:58 AM

The parents of the 15yr old knew she had problems. Maybe they couldn't afford mental care. Maybe no insurance. Maybe they begged the state for help with her, but you know how that can go. The state won't take action until something happens. If she has been evaluated and found incompetent, then sorry, she's already not guilty. I hope she's competent, but we won't know details til it's over.

I am sick at this killing and the many others that I have heard about this past year. Good lord theese families shoudn't have to go through this. It is horrible! My prayers go out to all the families of lost ones and I hope the criminal is punished to the fullest degree. This girl should be treated as an adult. The judges and laws need to be tougher on criminals! The kids theese days have NO FEAR of conciquences. It starts young with the parents giving time out. Give me a break, give them a whippen like we got 40 years ago. Time out is a joke!!! I see brats with no fear of thier actions. Look at the kids that raped and beat the young girl at school while many others watched! Look at the poor boy in the hospital fighting for his life because others set him on fire! And recently a child is dead because her mother pimped her out. My God, My God this is what the United States has come too? Sad, Sad, Sad!!!

There are different kinds of mental disorders-and some people have more than one. Some-such as depression- are treatable with drugs and counseling. But this young woman appears to have the disorder that is basically impossible to treat. I say that because of the details of the case. She is a psychopath. Read the book "Psychopaths among us." They cannot be rehabilitated. It would be pointless to treat her as a juvenile and return her to society at age 21. She'll be dangerous all her life. She has to be kept in prison, away from opportunities to kill other innocent children in the future. She will never, not with all the therapy in the world, be normal.

Posted by: debra at November 19, 2009 9:15 AM

Never mind making excuses for this so called child. She could be very well possessed by a demin spirit. Children are perfect hosts for suc things. But nonetheless a child by the age of eleven certainly knows right from wrong and should be held accountable as an adult. Get an excorsist and a strict judge. Most importantly, learn from the signs before the incident so that this hoorror doesn't re occur to someone elses poor child. Parents keep your children safe from such. Teach them to be picky and cautious about their friends. This world today, one cant take things for granted.

Posted by: grace kamuhanda at November 19, 2009 9:17 AM

this is what happens when parents expect television, video games, after school programs, the neighbors and everyone else in the world to raise their children. Stay at home a little more. make a little less money. Sacrifice. Teach them to sacrifice. Don't just talk to your kids, LISTEN! Children cut themselves so they can hear and feel their own pain, because no one else will. Anyone can make a baby, but not just anyone can be a good parent.

Why not? Are you all stupid or what? Have any of you watched evening Programming on TV? I am so sick of the trash broadcast every evening. It isn't enteraining if someone dosen't get shot or cut to bits. You all are getting just what you wanted entertainment, only now you can't understand why it is in your neighborhood instead of on your TV, come on,you get what you all want, its just getting to real now isn't it.

Posted by: winston at November 19, 2009 9:37 AM

Okay.........There is a difference between run of the mill mental illness and sociopathy. Normally, the mentally ill have remorse and sometimes, they can have temporary states of disassociation or psyhotic behavior BUT one who is cold blooded with no conscience is a sociopath, which is not actually mental illness, but is worse because there is no moral compass.

Once again, we equate "normal" with good and "insane" as bad.

I am as crazy as a loon, but I have never had the desire to do harm, thanks. At age 16, I was busy riding horses, so I don't know. I normally just avoid anyone that I dislike.

sorry about the 15 yr old but ,not really! i am sick of the excuses we make for our kids bad behavior . time to end the excuses and begin the consequences yep thats right we have avoided the facts long enuff . this stuff did not happen everyday in my dads time . why is it so today no consequences . we are at fault period for the troubles of our kids because we have failed to show them that for every action there is an opposite and equal reaction . you break the law you go to jail or as a kid you get your ass tanned good with a paddle and you know if we start right now . we may yet save our world but if not we are looking the end in our children .

Try her as an adult. The sad thing is, she will most-likely get lost in the system. She commited murder. Her past and present and future...is irrelevant to the degree that she killed a child. I dont care if she wanted to learn what it felt like...get her a hobby like hunting "animals" or something...but a 9yr old girl and stabbing her, and slicing her throat? Save us all some trouble and offer her a life sentence or the death penalty. Or...have the state or federal government fit the bill to get her into treatment and maybe theres a light at the end of the tunnel...hmmm....damn...not in this current judicial system.

"Take a step back and put ourselves in parent mode....this child needs psychiatric help."

HAHAHA, yeah let's put ourselves "in parent mode" in the shoes of the parents who just LOST their child. Would you want this girl to get away with murder by just having to see a "psychiatrist?" WHAT ARE YOU CRAZY????

Their daughter was just brutally murdered, HELLO!!!! At age 15 you KNOW right from wrong.

As for the media calling saying she was "mental"
ummmmm, DUH! You would have to be mental to murder someone. Haha, it doesn't take a genius to figure that out!

TRY HER AS AN ADULT!

Posted by: Bay at November 19, 2009 10:07 AM

Spell check is your friend, and all of this thumping is not necessary. Just because we are in the midst of bible belt slinging the devil made her do it makes me want to hurl. Most kids are screwed up today, their parents were raised by boomers, and you know how those are, myself included. There is too much stress in the world, too much uncertainty and doom at every corner, but keep the devil and satan and crap out of it. Feel empathy for both parties, the 15 year old and the victim. Blame video games and tv if you must but lay off of the religious crap. PLEASE.. it just makes Missourians sound back hills. You all sound like the lady on Wife Swap and the fat ass about gargoyles, who wouldn't take the money.... but then did take the money, Now, take a big dose of stfu!

Posted by: cypriania at November 19, 2009 10:10 AM

First, stop w/the satan references...satan didn't make her do it. Stop using religion to make excuses. Next, my father suffers from mental illness...over and over I tried to get him help when he went off his meds...no one seemed to be able to do anything...it wasn't serious enough or he needed to do something worse, and one even said he had to get in trouble in that county TWICE before they would do anything. On writing/calling TWO national mental health groups, NO ONE answered my inquiries. I was on my own.

People don't take mental illness serious enough. They want to pretend it isn't happening, or it's not that big of a deal. Many of the ones who are sick think the drugs aren't neccessry (sp?).

And one other thing...television doesn't make people go out and murder...sure the kids watch too much, but if you are bad enough to want to do something so horrible as murder, you're mentally ill. If you let peer pressure cause you to do something that bad, you're mentally ill. We've all had peer pressure...most of us managed to have enough of a backbone to say no.

She committed an adult crime...she should be tried as an adult. Study her...maybe it will help you help someone else...but she still needs to be punished.

Posted by: KD at November 19, 2009 10:14 AM

The bottom line is everyone has a choice. I think everyone should be accountable for what they do, this girl know what she was doing and should be punished accordingly. Perhaps if our laws were tougher these things would not happen. The same thing should be done to this girl. The Bible says if someone punches you in the eye, punch them back. So if she cut someone throat hers should be cut too. We should punish to the fullest to stop this nonsense in our world. Let our kids be kids.

Posted by: Anonymous at November 19, 2009 10:14 AM

In my opinion, anyone that commits murder suffers from some sort of mental health issue. Let's face it, it is just not normal. Does this mean that the crime should go unpunished? No, it does not. Our laws have been set up for the protection of law-abiding citizens. Regardless of the mental state of any murderer, there should be swift, definitive action in murder cases. Our society is headed down a road that we will not be able to turn away from. For many years, our courts have become more and more lenient. Law Makers have pursued the abolishment of capital punishment. The message that this has sent to the criminally-minded is that society is willing to accept this behavior. Present day teens have no regard for the sanctity of life - they place no value on the life of any individual including their own family. Locking those that are willing to murder away in prison or in a mental institution does nothing to resolve the mental abnormality. If the murderer is allowed free, there will always be that potential that they will murder again. Another issue I disagree with is how capital punishment is carried out. If one was given the choice between a horrific punishment and one that involves little to no pain, one would obviously choose the lesser. What punishment are murderers faced with? Murders have two options if convicted. Life imprisonment (often with possibility of parole) in an environment where they will be fed, clothed and housed and have some form of entertainment for life. Death Penalty where a lethal dose of chemicals is introduced into an IV and the convicted simply falls asleep never to awaken. What are we talking about? Putting the family pet to sleep? We're talking about a murderer, someone who planned and carried out the murder of a poor, defenseless 9-year old little girl. I think all individuals who are convicted of 1st degree murder should be put to death in front of a firing squad.

To everyone crying for the death penalty: you can't put anyone under 18 to death no matter what they did. Look up Roper v. Simmons, 2005 USSC case. Doesn't matter if she's tried as an adult to not. They ruled that the death penalty for juveniles is unconstitutional.

She can be tried as an adult, spend her life in prison...but she won't be put to death.

Posted by: Cherry at November 19, 2009 10:50 AM

I agree with Hannibal (not Lecter). If this 15-year-old girl were a boy, the prosecutor would spend little time deciding to try her as an adult. Let her go through the system as an adult and let a jury sentence her as justice sees fit. As far as mental health goes, pleading 'insanity' as a defense is not as easy as people might think. The law is pretty clear in most states as to just how 'crazed' one would have to be while thinking about the murder, going through the act of the murder, and after the murder was committed.

Posted by: DLB at November 19, 2009 10:53 AM

She knew right from wrong. She murdered a 9 year old CHILD- just b/c she wanted to know what it felt like? Then she should be put to death and then she'll really know what it feels like! Eye for an eye.

My heart breaks for both families involved in this. For the family of the little 9 yr old girl....who will never ever see their daughter graduate from high school or get married or have babies....This is totally UNFAIR. Then for the 15 yr old that comitted the murder. What had to be going through that childs head when she comitted all this mayhem. I also am not accepting her excuse of I wanted to see what it felt like. First off, SHE felt nothing.......she wasnt on the receiving end of all of this. Secondly, being made to pay back an eye for an eye............I dont think this is right either. However I DO think she needs to be punished for all of this. I feel that she needs to live long enough to be able to have to look that family in the face EVERY DAY know that they know what she did to their daughter. Putting her to death is a cop out. SHe needs to LIVE FOR THE REST OF HER LIFE knowing what she did at age 15. However she also needs to be incarcerated FOR LIFE with no chance of parole.. Made to live with her consequences. Death is a cop out and the easy way out of things....

Posted by: Anonymous at November 19, 2009 11:08 AM

im sorry at 15 u KNOW that its not socially acceptable to go kill children..i know mentally handicapped people that know that much....so as for all this (supposed) crazed 15yr old talk...she knew what she was doing while she did it. she committed this with her own hands. u know who else has hands??? the devil! lol.... stop giving allowences for murder by saying she was posessed n all that crap. n dont go blaming TV n games.. try not buying them..or hell install a v-chip why dont ya? she can't be executed seeing as she's a minor...lucky her.. but she should be given atleast 30 years if not life. she should understand that murder is not ok...under most circumstances..and it's highly unlikely she was protecting herself from a 9 yr old....o n btw...she STRANGLED...THEN...STABBED her to death. that sounds like premeditated murder to me..she made sure the girl wouldnt be able to get back up....so all u bible thumpers go ahead n say its not her fault =) just enjoy living with a twisted sense of things...it's worked out for you so far right? she was sane enough to plan this out...she's sane enough to get life without parole.

Posted by: matt at November 19, 2009 11:25 AM

In Missouri, as in most other states, juveniles are ALWAYS certified to stand trial as adults in murder cases like this. The law requires a certification hearing for all persons under the age of 17 in Missouri, before they can be prosecuted as adults. An "adult" is anyone age 17 or older on the date of the crime. As for the death penalty, the U.S. Supreme Court has ruled that no State may seek the death penalty for murder first degree crimes committed by persons under age 18 at the time the murder was committed. So there will be no death penalty in this case, no matter how viscious and premeditated the murder. A mental disease/insanity defense will not work for the killer, due to the enormous amount of planning involved prior to her commission of the murder, and due to the killer's stated motive for the crime (wanting to see how it felt to kill someone). If a plea bargain is not reached for a plea of guilty to the lesser charge of murder second degree (with a sentence of something like life imprisonment with the possibility of parole after 26 years), and the case instead goes to jury trial, the killer will be convicted of murder first degree and sentenced to life imprisonment without the possibility of probation or parole.

Posted by: keith at November 19, 2009 11:28 AM

I honestly don't know what should be done with this 15 year young murderer. On one hand you want to "fix" her and on the other hand you want to see her put to death. Who's to say that she can be "fixed"? Two wrongs don't make a right, but we do have to use these "broken people" as an example for future murderers ect... Let people know that there will be severe punishment placed upon them. All I can do is shake my head and ask why. It brings comfort to me knowing there is a GOD and also that I don't have to keep my "religious diatribe" in the church. May GOD save us all.

Posted by: kathy at November 19, 2009 11:28 AM

I'd like to talk with the 15 year olds parents and psychatrist ... clearly there were some strong indicators that violence was a possibility, probability. I took care of my scitzophrenic sister for 15 years, at the first signs of any indication of violence we had her committed, sometimes several times a year. It was heart breaking watching her being carried away by 6 police officers while kicking and screaming - but in the end, everyone was kept safe.

Posted by: Anonymous at November 19, 2009 11:33 AM

I like how we all blame SATAN for this. The "creature" from underneath. How about the people of this nation start taking some responsibility for their actions? How about we hold a 15 year old child accountable the same we hold an 18 year old accountable? I'm 31, and know that if I kill someone, my life is PROBABLY over... The concept of right and wrong in this country has been so diluted by the words "He's just (insert age here) years old". Its my contention that the "age of majority" is outdated. 18 is the legal age in this country because anyone under that age is in the minority of people in the US. I contend this... I say most people in this country are over 15. Is it true? Of course it is. Simple Logic. Start putting these "kids" in prison. Set a precedent now. The same reason I dont kill my ex wife, or the guy who cuts me off (nearly running me off the road), is because of fear of the law and a moral obligation to remain civil. After a few dozen of these kids get life sentences, you will see the madness slow drastically.
Life is about responsibility and accountability. If we send this girl to a half-way house or "juvee", and she's out in 3 years, then what has she learned? That killing is ok if youre under duress, get bullied, or (the time-honored classic) under 18 years of age.
Wake up America. Stop giving your problems to the invisible man up in the sky, and blaming the root cause on the invisible "monster" below. Religion has become a scapegoat, mutating from a core of beliefs that didnt rationalize this kind of behavior in this world.

Posted by: Rocco Parisi at November 19, 2009 11:35 AM

She is a sociopath. She doesn't have emotions like you and I do, so she needs to do things like this to make her feel something - anything. Same as Ted Bundy. And it's not like she shot the child from a distance - she was up close and personal with this murder. She really wanted to feel it - taking a life. She cannot be rehabilitated, and being put in an institution until she's 21 will do nothing. She needs to either be locked away her entire life, or put to death. By the way, she knew that what she was doing was wrong. She hid it. Most do - they know enough not to commit their crime right in front of a police officer.

Let's not lose sight of the fact, that 15 year old male or females are often married with families of their own in many countries. Even here in America, until recently, 15 year old male and females could marry in several states. The law has been raised to 16 with parental consent. The real issue is the mental illness. However, it is hard to avoid a conviction on mental illness. Why? Because everyone tries that excuse and the courts and juries are wise to that game. If this young woman (and yes, at 15 years she is a young woman, not a child)was so mentally disturbed; then her parents are liable for allowing her the freedom to do this horrific crime. Just because she has had some counseling (who hasn't in this day and age) isn't enough for an insanity plea. Her previous suicide attempt could have been a plea for attention. Pick up a newspaper in any state, this behavior trait is becoming increasingly common among some insecure and slightly unstable youths. Either way, try her as an adult. When she is convicted, she will be sent either to a mental hospital or prison. Either way, she will receive mental evaluations and proper treatment.
Without going all "bible thumper" on you. I hope enough of you are smart enough to see the signs in these latter days. Apathy, wars and rumors of wars, apostacy, etc. Everything this young woman and other like her do, have been foretold long ago. Bury your heads in the sand or open your eyes and prepare for what is coming.

This 15 year old girl is mentally ill, and someone missed the signs. As heinous as this crime is,it was committed by someone who shows the attributes of mental illness. Where was the help for her? Granted, she has no place living in society-but she is a child of God as well and needs caring for. Nothing can take away the hurt and pain she has caused, and my heart goes out to the family of the 9 year old. Rather than casting uneducated judgments-let us all endeavor to help identify the mentally ill in our society-and get them the help they need so that acts like this never occur.

She should be tried as an adult. This was premeditated, that means she knew exactly what she was doing. She knew it was wrong, yet she still planned, and then carried out the murder. Her own actions demonstrate that she understood the meaning behind them, that she was aware of her actions.

My prayers will be reserved the victim's family only. The loss of your child is devastating, but the reason behind the loss is beyond devastation.

She should spend the rest of her life in jail. Period.

Just from her statement to the police officer that she did it just to see what it felt like, it would appear that she has a serious mental condition - she is a sociopath.
Think potential serial killer. Sociopaths have no empathy for others, no guilt, no remorse. Yes, she is old enough to know right from wrong BUT sociopaths are generally unable to differentiate. Other people are merely objects, there for their amusement, like toys. They lack a conscience.
Sadly, this condition is increasingly viewed as a type of brain damage. Sociopath's brains are significantly different from a "normal" person's brain if a variety of scans are compared side by side. It is not a treatable condition. If some kind of treatment is attempted, most sociopaths just go along with it until they can con the therapist into believing they are cured. She is not possessed by Satan or any other demon. She is a sociopath. She will always be a sociopath. And as such, she needs to be locked up away from the general public, because if released, she will most likely have no qualms about killing again. Just to see if it's the same.

Think about this rationally everyone the girl has mental issues which were established BEFORE she decided to commit the crime, this means her brain doesnt function as it should. Its fine for you to all go on about shooting her but she has mental problems for christs sake by wanting her to die just shows that you yourselves are as bad as her. She should be tried as an adult but not put to death because its not her fault that she has mental issues, she had the choice to kill the girl yes but as i already pointed out she has mental issues which means that she doesnt think properly which means she cant make a rational decision about it!!! Everyone that takes away anothers right to live doesnt deserve the right to live themself but if you take that right away from them arent you just as bad as them?

Sorry, slight amendment - as she is under 18, she would be classed as having "conduct disorder", rather than "sociopathy" or "psychopathy"

There is no help for this sick person.... She apparently is missing some major brain cells that gives her any compassion. Anyone who can take a knife to a child needs to be put away FOREVER!!! No amount of help is going to change her and these stupid lawyers are just plain STUPID. Why are we so concerned with the idiot, instead of the poor child who will never have a chance to live her life. Put her away so she never has a chance to do this to any other child!!!

Give her the death penalty, she is old enough to take responsibility for her actions. We can't afford to give an inch to freaks like her. They are a drain on society, we don't need them, or want them.
