Virginia Naked Trial


Are you allowed to be naked in your own home? Most Americans might take for granted the answer is yes, but one case of a man arrested for indecent exposure inside his own house may set a different precedent.

The man was in his own kitchen minding his own business, when a woman and her young son were walking across his front yard and saw him in the nude. Which to me raises the question: why were they in his yard? But for the woman it raised the question "why is that guy naked" so she called the police who came and arrested him for being naked in his own kitchen.

Is this right? I've got to hope his lawyers can prove this is a miscarriage of justice, because it seems wrong to me.

A Virginia man was arrested for being naked - in his own home. Eric Williamson was making coffee in his kitchen Monday morning and didn't thing anything of the fact that he was nude since he was alone in the house, according to WTTG-TV. But a woman and her 7-year-old son happened to be strolling through his front yard and saw the 29-year-old having breakfast in the buff through his window.

I agree with "baffled". The police arrested the wrong person. Seems like the woman should have been arrested for trespassing and peeping. Now if she had been on a public sidewalk, street, or something it might have been different.

Phil has the key point here: Could he be seen from a public area, such as the sidewalk or the street? If he could be seen with no effort from outside his yard, then, yes, it would be indecent exposure. If that particular window through which they saw him wasn't facing such a public area or if his drapes were drawn and they made an effort to look through any partition, then the mother and her son violated his privacy. On the surface, it sounds very ridiculous (nuts, even just below the surface it does, too), but to judge it fairly we need not only the physical layout of the "crime" and a very justifiable reason why the mother and her son were on his property.

I don't know about VA, but in PA a person cannot be charged with trespassing unless they were first told that they are not allowed on your property. At least that's what I was told. So it's possible she CAN'T be charged with trespassing.

This man was in his home. It appears he was wrongly arrested and charged and if I were on this jury he would without a doubt be found innocent. thanks

I think the police were in error. Since when is it a crime to be nude in your own home when you are alone. She definitely was tresspassing if she was on HIS property looking in HIS window. Here is another example of taxpapers money being wasted....I suggest the police look at the error in judgement they made and apologize to this man.

Soooooo...I guess this means I have to take a shower with my clothes on? Wouldn,t want any one seeing me in there you know!!!! Hmmmm and by the way, me being the man I am.....what the heck were they doing looking through my window? I sure wouldn't do that to them...invasion of privacy by my thinking, not to mention they WERE on his property. I have a normal front yard and if I was eating in the buff, no one could see a thing....besides I would be the one embarrased if I was on someones property and saw something I should not have....great....teach your kids to trespass and then attack the property owner....gotta love the backwards mentality taught to our children.....she should be repremanded, the gentlman should be allowed to finish his breakfast as he pleases (thought that was why I bought my own house anyway) and the child should be tought the Law, as his parent dosn't seem to have PROPER manners....The state of things is apparent in this country....so we do so do our children do to a greater degree....
May that gentlemen be sent home to finish his breakfast(it is probably cold by now). And that "Lady"and her son be on there way, to live as they please in the property THEY pay for.

A few people hit on the real issue. It's not a question of whether the woman is nuts or knows what she's doing, nor a question of whether the man was in the wrong. It's a question of whether the authorities have any brains anymore (or not). At the last, the question of who gets hauled off to the local precinct was for the police to decide, and they apparently got it wrong. The government is evermore intrusive in our private lives, and the intrusiveness is more and more completely against the grain of any common sense or logic. But then Mark Twain got it right when he said every population gets the government they deserve (the one they voted for).

The scary thing in this case is the government intruding on someone's Reasonable Expectation of Privacy in their own home. The woman was an idiot, clearly. You don't look into the windows of someone's home-that's rude. If you don't like what you see, don't look.
But the government is actually prosecuting this man, and that is part of the erosion of privacy and individual rights in this country. We are slowly losing our rights, and soon will be living in a 1984 type nightmare unless people speak out about these issues.
I'm going to send money to this guy's defense fund and a letter to his congressman. Or else next it will be me on trial for walking naked to the laundry room after my shower to grab some underwear.

But if he was just walking nude in his home and merely forgot to close the drapes then he's innocent.

And why was the woman looking in people's windows in the first place?

I mean I can understand glancing at houses, I do, just to admire the building or laugh at it but I won't 'look' inside.

And the poor guy lost his job over the incident and has a five year old himself, I sympathize with him I do the way the economy is and that three million Americans are unemployed.

I hope he wins the appeal, gets his job back and just let the matter drop so we can all go back to our nude lives.

The question should be why would the police take the time out to answer the call. Was it another woman(police) who came and arrested him. Did she evenlet him put somthing on befor she took him to jail to have proof that he committed a crime.

You have to look for more than a split second to really know if someone is naked, and she had to be pretty close to that window. I think they arrested the wrong person here. I walk around my house naked all the time. Are they going to get me next? No one better be looking in my windows either!

how stupid. being nude is not a crime in your own home. He was not commiting a sexual act and he was not attempting to expose himself to the neighboors. I walk around my house nude too!

Having someone arrested in their OWN home for being naked is beyond ridiculous, the person who should be arrested is that imbecile of a woman who called the police. Not only did she violate the man's rights by peeping inside his home but as the other posters state she was trespassing on his property! What is she teaching her child?

I saw the news report on Fox when this guy was first arrested. He said that for her and her son to see him nude, they had to be on his property. Can't believe he was actually convicted, on second thought, yes, I can !!!!! Big brother gets bigger every day !!!!! George Orwell's 1984 is fast become a reality. The scary part is that it is happening in our country not Russia !!!!It is no wonder there arer so many american ex-patriot's!! More and more, I think I might be joining them !!!!!!!

Although there have been many good points raised, I still think that people are missing the biggest issue. How has our society gotten to the point where being nude even in the absense of any overt sexuality is considered criminal. Even from the childs perspective if the woman does not make a big issue of it, all he sees is a man the way God made him. If her son has an issue with it at all and he probably doesn't, it will be because of her reaction rather than something the he saw. Frankly what I think is disfunctional is when children never see a naked adult and are taught that the human body is "bad". Children should be taught the the human body is not bad it is natural, and that being naked is not the same as being sexual. Or to put it another way I would rather have them see a naked man eating breakfast than a fully clothed woman "Freak" dancing.

Many so called facts are vague BUT with what I can read myself, her neurotic reaction was uncalled for. There are many other things out there that are more offensive to me. For example, men wearing their jeans off their @## showing their butt and pubic hair, large obese females wearing short wife beaters with their boobs flopping out in the breeze and speedos 3 sizes too small with "Baby Phat" wmblazoned on the A**, etc etc etc.
As for walking through his yard, what's up with that? Peeping Tomasina? ?Invasion of privacy? Most kitchens are not located in the front of houses to where you can see directly into that area from the street or sidewalk. So anybody walking through a back yard could see anything. What was she doing there anyway?
Pretty soon you won't even be able to fart in your own home due to "noxious emissions" Yes your basic freedoms are gradually and quietly being taken away. Wake up folks, this isn't just about this issue!!!!!!!!!!!!!!!!!!!!!!!!

We all know the real story here, the woman saw him, liked what she saw, went in for a closer look and then in fear that her son would tell his Dad she was gawking at the sexy naked neighbor she diverted marital discord by making a report to her hubby - a COP! Had she been alone she would have peeped, got her jollies and not said a word. Why else would she have cut through this particular man's yard but in the hope of seeing him? She likely just didn't think he'd be naked - maybe she thought she'd get a peek at him in his undies. Either way she is in the wrong. She should have walked on and minded her own business not his.

This is stupid. With everything going on in the world VA needs to worry about what a guy is doing in his own home. I could see if he was running around the streets, what the heck is she doing peeping in his windows? With her son no less. The police should have some questions for her... but then again since they arrested him they aren't smart enough to be asking any questions. I would suggest that someone investigate that police dept. cause you have to pass some tests to be a cop. Maybe someone is fudging test scores????

If he would have kept his blinds down it wouldn't be an issue. I know I don't want to be walking down the street with my daughter and see a naked guy whether it is in his house or not if he can be seen then it should be considered in the public. The headline to this story is not accurate. The man was NOT simply walking around his own home naked. He was purposely putting himself in position to expose himself to people outside his home. C'mon folks, I know our society is tanking but you don't have a right to PURPOSELY expose yourself to others (outside your home) whether you are inside or outside your home. There's no Kings X that says "I'm in my house so I can flash you all I want". The guy got what was coming to him. He should have been arrested and prosecuted. Police DO know the law and did the right thing in this case so stop blaming them. The idiot man is the one that was wrong and he has to suffer the consequences. Lord knows we don't hold anyone accountable for anything any more. Easier to just blame police. Wake up!

It sounds more like she was invading his privacy to me, and the fact that he went to jail is by far the most BS. She must have really been looking hard to see that if you ask me. So i guess we can't get out of the shower and walk to our room naked because its against the law. Wow...it's indescent exposure for being in your own home. This is why i HATE the police and government. That's a false arrest by far, and his lawyer has an open and shut case.

I am 65 years old. I have a 40 acre farm. I go out into my fields and into my forest if I want nude. This judge needs to talk to me. On my property, not in his courtroom. He is the kind of judge that will let a child rapist off, and put people in jail for what this man did, or if somebody smokes marijuna. Judge, send your best. If he was near an open window, that's the only way I can see the woman's point of view, at least somewhat. She should not have been in his yard and she shouldn't be looking inside other people's houses. And to claim that he was trying to expose himself to her and her son is ridiculous because he was only trying to make coffee and perhaps didn't even realize that he had left the blinds/curtains open.

And I'm also wondering, it doesnt say what time in the morning it was, but I don't know why that woman was taking her son for a walk in the morning, shouldn't be at school or at least heading for school? And even if she claims that she was walking her son to school, she still shouldn't be on his yard.

I want to thank all of you - those involved in this fiasco and those of you with such great comments. I was really down in the dumps but you made me laugh so hard that tears ran down my face. The whole thing is sooo stupid. My grandchildren spent 3 weeks with me and while I miss them, I was happy that after they left I could once again run around the house communing with nature.

Unless this guy has only one foot of front yard she was snooping on purpose. First thing I thought when I saw this was that she was related to a cop. Thanks for confirming, Brenda. I believe that police department should file a letter of reprimand into whomever's file it was that authorized this arrest. Lets face it. The woman in question obviously knew she could make this happen; a "normal" person wouldn't have to immediately call anyone to tell them about this. Some group should do an evaluation of the entire police dept's arrest records. I doubt this is an unusual case.

People do have the right to be nude if they want in their home, but when they can be seen from the front of the house it then becomes an issue. Imagine if you had kids riding their bike down the sidewalk and saw that.
